Practice Areas

I strive to help my clients in each of my practice areas so that they can achieve their reasonable legal goals. Since I have approached the Colorado Bar in 1999 and the New York Bar in 2012, my life experiences inform my practice, giving me a better understanding and empathy with people than most lawyers.

Bankruptcy Law

 

I help clients file for Ch. 7 and Ch. 13 relief under the Bankruptcy Code. There are many issues to be addressed in each filing, so that clients can get a "fresh start", financially, which is the aim behind this part of the United States Code.

 

Filing BK cases since 2003, I find that many people are using the system now who would not have done so in the past, due to the horrific financial situation we find ourselves in.

 

Family Law

 

From Divorce to Child Custody, Parental Rights, Restraining Orders or Enforcement of Child Support/Maintenance all the way to Wills, Trusts and Probate issues, my firm conscientiously helps clients with their family law needs.

The system is frustrating for people to negotiate without an attorney. My firm strives to help clients achieve their goals with the help of the legal system.

 

Commercial Law

Clients needing business contract negotiation / creation / amendments or litigation pursuant to breach or non-performance are valued at my firm.

Sometimes all it takes is a "demand letter" to set things straight. At other times, commencing litigation helps motivate parties to adhere to contractual terms.

 

Not all marriages rise to the ideal, and some just deteriorate over time. While recommending counseling whenever possible, we recognize that sometimes, a marriage just doesn't work.

​

Mediation or "dispute resolution" is one way to work out issues in a marriage without seeking a divorce, but, again, some marriages are so far gone that the parties just call it quits.

​

We can (and do) help our Family Law clients to engage their spouses in mediation of disputes in attempts to resolve conflicts. The Courts in Colorado also demand a 90-day "cooling off" period between filing a Petition for Dissolution of Marriage and the issuance of a Decree of Dissolution, to allow both parties reasonable time to re-evaluate whether in fact the marriage is "irretrievably broken".

 

Sometimes an opposing party simply does not comply with Court Orders, so my firm helps clients use the Courts to enforce or modify Orders, whether they be for Parenting Time/Custody, Child Support or Spousal Maintenance.

​​In the business marketplace, it is a "war of all against all" and a "dog eat dog world", so you have to arm yourself with not only the skepticism that has to be inherent in business dealings, but with legal counsel, to ensure that your business dealings are executed in a manner that best meets your interests and needs. It is advisable to enter into contractual negotiations and relations only after careful consultation with legal counsel.

My firm helps people create the entities they desire to suit their financial needs, create and enforce the contracts (employment, vendor and B2B) they make with others to buy/sell their services/products.

Colorado has created a Pilot Project and demands use of same in select counties in 2012. We are also gravitating to ICCES starting in January 2013. These transitions need to be smooth and seamless and hiring counsel is one step to making your business run efficiently and compete strategically in Colorado.

Burdensome debt is becoming an increasingly common occurrence for people all over, and has the potential to ruin lives if not dealt with in a timely manner. If creditors take your debt to court and get judgments, they can: garnish your wages and/or bank accounts; put liens on property (preventing its sale); and can seize personal property with the aid of law enforcement to satisfy that debt. In short you can lose everything if your debt overwhelms your financial ability.

Homes, possessions and futures can be ruined, unless people take advantage of the Bankruptcy Laws that are specifically designed to prevent such calamity.

Bankruptcy protection is in place to protect you from creditors, to arrange your finances to give you a "fresh start", it "gives to the honest but unfortunate debtor…a new opportunity in life and a clear field for future effort, unhampered by the pressure and discouragement of preexisting debt."
